1. Nature of Services

MR BRANDING is a Technology Service Provider and Digital Marketing platform. We provide CRM, ERP, and WhatsApp Business API solutions to businesses including insurance advisors, agents, and brokers.

Important Disclaimer: MR BRANDING is NOT an insurance company, insurance broker, or corporate agent licensed by IRDAI. We do not sell insurance policies, collect premiums, or provide insurance advice. We only provide software tools for insurance advisors to manage leads and communicate with their customers via WhatsApp.

2. Services for Insurance Advisors

Our platform enables IRDAI-licensed insurance agents/advisors to:

  • Manage customer leads and policy renewal reminders via CRM

  • Send transactional updates: premium due dates, policy documents, claim status via WhatsApp API

  • Send marketing campaigns to opted-in users using Meta-approved Message Templates

  • Provide 24x7 chatbot support for FAQ related to term insurance, health insurance, etc.

3. WhatsApp Business Policy & IRDAI Compliance - MANDATORY

All insurance advisors using our platform must comply with:

  • Meta WhatsApp Business Policy: Obtain explicit opt-in from prospects before sending any marketing messages about term insurance, health insurance, or investment plans. All promotional messages must use Meta-approved templates.

  • IRDAI Guidelines: All communications must comply with IRDAI (Insurance Advertisements and Disclosure) Regulations, 2021. Mis-selling, misleading benefits, or guaranteed returns are strictly prohibited.

  • No Unsolicited Messages: Sending unsolicited insurance offers via WhatsApp to users who have not opted-in will result in immediate account suspension.

  • Disclosure Required: All messages must clearly mention the insurance advisor's IRDAI license number and the name of the insurance company.

4. Tech Provider Role & Advisor Responsibility

MR BRANDING acts solely as a Technology Service Provider. Insurance advisors using our platform are independent entities solely responsible for:

  • Having valid IRDAI license to sell insurance

  • Content and accuracy of all insurance-related messages sent to customers

  • Obtaining and maintaining proof of user consent/opt-in as per DPDP Act 2023

  • Compliance with IRDAI regulations, AML guidelines, and all applicable laws

  • Handling claims, grievances, and policy servicing - MR BRANDING has no role in this

5. Prohibited Activities

Insurance advisors may NOT use our platform to:

  • Send messages promising guaranteed returns on ULIP or investment plans

  • Compare insurance products without proper disclosure

  • Send messages to users below 18 years for life insurance products

  • Misrepresent policy features, benefits, or exclusions

  • Use our platform if they do not hold valid IRDAI license

6. Data Storage & Privacy

All lead data and customer communication records are stored on Hostinger VPS servers located in Mumbai, India. Data is encrypted in transit and at rest.

Customers may request data deletion via Data Deletion Page or email privacy@mrbranding.pro.

7. No Financial Advice

Information provided through our chatbot or platform is for general information only and does not constitute financial, insurance, or investment advice. Users should consult a qualified IRDAI-licensed advisor before purchasing any insurance policy.

8. Limitation of Liability

MR BRANDING is not liable for:

  • Any mis-selling or misrepresentation by insurance advisors using our platform

  • Claim rejection or policy disputes between customer and insurance company

  • Account suspension by Meta due to advisor's violation of WhatsApp policies

  • Financial losses arising from insurance purchase decisions

9. Termination

We reserve the right to terminate access for any insurance advisor found violating IRDAI guidelines or WhatsApp Business Policy, without prior notice.

10. Governing Law

These Terms are governed by laws of India, including Insurance Act 1938, IRDAI Act 1999, and DPDP Act 2023. Disputes subject to jurisdiction of Delhi courts.
